This Privacy Policy describes how Launch On Demand Group Inc. (“LOD” “we,” “us,” or “our”) collects, uses, discloses, and protects your personal information when you use our mobile application (“LOD Mobile App”) and related services (collectively, the “Services”). By using the Services, you accept this Privacy Policy, as well as our Terms of Use, as may be amended from time to time, and you agree to the collection, use, and disclosure of information in accordance with this Privacy Policy. We are committed to protecting your privacy and ensuring that your personal data is handled securely and responsibly.

Information We Collect

We collect several types of information from and about users of our Services in order to provide real-time maritime safety alerts and related features. This includes:

Account Information: When you register or log in via third-party accounts (such as Google or Facebook), we collect your name, email address, and public profile information as allowed by those services. We also ask you to provide a mobile phone number during registration. These identifiers help verify your identity and enable login and direct communication with you (e.g., sending alert messages). We do not receive your passwords or any data from those accounts beyond what is necessary for authentication.

Location Data: We may collect precise real-time GPS location data from your mobile device to power core features of the LOD Mobile App. This may include your continuous geographic location, even when the LOD Mobile App is running in the background, to determine whether you are approaching or have entered a restricted maritime zone. We treat your GPS location data as highly sensitive and confidential, and do not share your real-time personal location with third parties except as needed for the safety purposes described in this policy.

Device and Technical Information: We may automatically collect certain technical details when you use the LOD Mobile App, such as your device model, operating system version, unique device identifiers, IP address, app version, and device settings. We use such information to, for example, ensure compatibility, deliver push notifications, and maintain the Services’ performance and security.

Usage Data: We gather data about your interactions with the LOD Mobile App, such as feature usage, pages or screens viewed, date and time of access, and any errors or crash reports. We may use the collected data to analyze and improve our Service’s functionality and user experience. For example, we may log when you view maritime exclusion zone maps or when notifications are sent to you (and whether you open them).

Preference and Voluntary Information: If you choose to save favorites or preferences within the LOD Mobile App, we will store that information associated with your account to provide personalized guidance. We may also collect any information you voluntarily provide to us (e.g., when you contact customer support, give feedback, etc.).
We do not knowingly collect any sensitive personal information beyond what is described above. In particular, we do not ask for or intend to collect any financial information, health information, or government ID numbers through the LOD Mobile App.

How We Use Your Information

We use the collected information for the following purposes:

Providing Core Services: Your location and account information may be used to deliver the LOD Mobile App’s primary features. For example, we may use GPS data to determine whether you are in or near a maritime exclusion zone during a rocket launch window, so that we can send you proactive alerts. We will notify you to vacate or avoid entering restricted zones when they are active and conversely notify you when a previously restricted zone has safely re-opened. These alerts allow you to adjust your activities (e.g., fishing, boating, kayaking, etc.) in real time and help prevent last-minute launch scrubs or holds due to unnoticed vessels.
 
Safety Assurance and Compliance: We may analyze location data to verify whether exclusion zones are clear of unauthorized vessels and to support launch providers and authorities in ensuring public safety. For instance, by knowing that a user’s vessel has left a hazard zone by the designated time, launch officials can confidently proceed with a launch and avoid costly delays. We may also use your information to provide you (and enforcement officers, if necessary) with authoritative confirmation of zone status. For example, the LOD Mobile App may display official clearance times from the U.S. Space Force or Coast Guard and your corresponding position to verify and document that you followed maritime safety advisories. 
 
Notifications and Communications: We may use your mobile phone number, app notifications, email, etc. to communicate important information to you. This may include sending push notifications or SMS alerts about active or upcoming restrictions, changes in status, emergency warnings, and Services-related announcements. Because these alerts are integral to the Services’ safety function, you will receive them as part of using the LOD Mobile App. We may also contact you directly for customer support purposes or to notify you of updates to the LOD Mobile App or this Privacy Policy.
 
App Functionality and Navigation: As discussed, the information we collect enables features such as real-time maps showing your location relative to launch trajectories, exclusion zones, and nearby vessels or buoys. For example, we may integrate environmental and maritime data (e.g. weather conditions, water temperature from buoy stations, etc.) into the LOD Mobile App’s interface to help you make informed decisions. As a further example, we may use your location and saved preferences to suggest safe navigation routes to your preferred fishing areas. If a restricted zone blocks your route, we could use your location to advise alternate timing or paths (including possible overland transport for small craft) to keep you safe. None of the environmental or vessel traffic data we display contains your personal data. It is either based on your own input or publicly available information.
 
Account Management and Authentication: We may use your account credentials (e.g., Apple/Google/Facebook login information, phone number, etc.) to authenticate your access to the LOD Mobile App and simplify your login experience. This login process adds a layer of security and helps verify that each user is a real individual. We may use your provided information to verify your account and prevent unauthorized access. For example, we might send a verification code to your phone when you register or sign in from a new device.
 
Security and Fraud Prevention: We may process and monitor personal information to detect, investigate, and prevent activities that violate our Terms of Service or are potentially illegal. This may include using data to identify suspicious or fraudulent accounts and to ensure the LOD Mobile App is not used by malicious actors. For instance, our administrators might review registration details (e.g., email addresses, phone numbers, etc.) that appear fake or associated with illicit behavior. We will take appropriate action if we identify misuse (e.g., an account registered under a false identity or used to facilitate unlawful vessel activity, etc.). Such actions may include disabling or deleting the account and, if necessary, alerting relevant authorities.
 
Improvement and Analytics: We may use aggregated and anonymized data that is stripped of personal identifiers to better understand how users interact with our app and improve our Services. For example, we might analyze overall patterns of zone incursions or how many users needed to be alerted during a particular launch window. Such information allows us, for example, optimize notification timing or interface design. We may use technical data such as crash logs and performance metrics to troubleshoot and enhance the LOD Mobile App’s stability and security.
 
Legal Obligations: We may use your data as is required to comply with applicable laws, regulations, legal processes, or enforceable governmental requests. For example, we may retain and use records of notifications or user locations that are relevant to an official investigation.
 
We will not use your personal information for purposes other than those outlined above without obtaining your consent, unless otherwise permitted or required by law. We do not use your data for third-party marketing or advertising purposes, nor do we engage in any automated decision-making or profiling that could significantly affect you without your knowledge.
 

How We Share Your Information

We understand that your personal information is important, and we only share it in limited circumstances aligned with the purposes described. We do not sell your personal information to third parties for their own use. The instances in which we may disclose data to others include:

Service Providers: We may partner with trusted third-party companies to assist us in operating the Services or performing functions on our behalf. This may include cloud hosting providers, mapping and location services, and communication/SMS services (to send text messages or notifications). These service providers only receive the personal information necessary to perform their specific services (e.g., your phone number for sending an SMS alert, your device’s unique push notification token, etc.), and they are contractually obligated to protect your data and use it solely for our specified purposes. They are not permitted to use your information for any other purpose.

Third-Party Login Authentication: If you use a third-party login (e.g., Google Sign-In, Facebook Login, etc.), those platforms may collect information about that sign-in process in accordance with their own privacy policies. We receive from them only basic account information to create or log you into your LOD account. We do not share any of your usage data back to them except as necessary for authentication or as required by those providers (e.g., to confirm a successful login, etc.). Please review the privacy policies of any third party login system you use for details on their data practices. 

Launch Authorities and Maritime Safety Officials: One of use primary goals is to enhance safety for rocket launch operations and maritime users. Accordingly, we may share relevant information with authorized entities such as the U.S. Space Force range safety officers, the U.S. Coast Guard, or other regulatory and enforcement bodies responsible for launch safety and maritime law. We do this only when necessary and under appropriate safeguards. For example:

  • If an exclusion zone violation is occurring or imminent (e.g., an unregistered vessel present in a restricted area, etc.), we might share real-time location data or vessel identifiers with authorities to help resolve the situation quickly and safely.
  • If a government range officer requests confirmation that a particular area is clear of registered app users, we may provide aggregated location status (e.g., “X number of LOD users present in Zone Y” without personal details, etc.) to facilitate a launch “all-clear.”
  • If required by law or in response to a lawful request (e.g., subpoena, court order, or emergency directive, etc.), we may disclose the minimal necessary personal information to the requesting agency. We will only do so in accordance with applicable laws and regulations.

In sharing data with these authorities or partners, we strive to limit the information to what is strictly needed for safety or compliance. Whenever feasible, we will notify you if your personal information has been requested by the authorities, unless we are legally prohibited from doing so.

Law Enforcement and Legal Compliance: Apart from the safety context above, we may also disclose personal information outside of our company if we believe in good faith that such disclosure is necessary to comply with the law, regulation, or legal process, or to respond to a valid governmental request. This includes sharing information if we believe it is reasonably necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the safety, rights, or property of any person, including our own systems, users, or the public. For example, if we detect that an account is being used for unlawful purposes (e.g., smuggling or unauthorized operations in restricted zones, etc.), we may report relevant details (e.g., the user’s registered name, contact information, pertinent location logs, etc.) to law enforcement or appropriate authorities. We may also use or disclose information to the extent needed to enforce our Terms of Service or to protect ourselves against legal liability.

Business Transfers: If we are involved in a merger, acquisition, sale of assets, bankruptcy, or reorganization, user information may be transferred to or acquired by a successor or affiliate as part of that transaction. We will work to ensure that any new owner or merged entity continues to uphold the privacy commitments made in this policy, notify you, and/or obtain any required consents. 

With Your Consent: In situations other than those above, if we ever need to share your personal information for any new purpose, we will notify you and obtain your explicit consent before doing so. For example, if we wanted to share testimonials or specific user stories publicly, we would only do so with permission. Generally, unless you direct us to share your information or consent to such sharing, we will not disclose your personal data to third parties outside the contexts listed in this policy.

We treat your data as confidential and do not disclose it except as described. We never sell your data or metadata to advertisers or unrelated third parties. We will work to ensure that any third parties with whom we do share data will be bound to protect and use it only for the intended purpose, as noted above.

Data Security

We take the security of your personal information seriously and implement reasonable and appropriate measures to protect it from unauthorized access, alteration, disclosure, or destruction. These measures include technical, administrative, and physical safeguards. For example, we may use encryption to transmit sensitive data (e.g., your location coordinates, etc.) over the internet. Data stored on our servers is protected by firewalls and may be encrypted at rest. We limit access to personal data strictly to employees or contractors who need that information to operate, develop, or support the Services, and they are subject to confidentiality obligations. We also maintain internal policies and regularly review our security practices to address new threats and ensure your data is handled safely.

Nonetheless, you should understand that no method of transmission over the internet or method of electronic storage is 100% secure or foolproof. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security of data. In the unlikely event of a data breach that affects your personal information, we will notify you as required by applicable law and will take all reasonable steps to mitigate the issue.

 

Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. 

Account Data: For as long as you maintain an account with us, we will keep the information you provided at registration (e.g., your name, email, phone number, etc.) and any preferences or settings, so that we can continue to operate your account and the Services. If you choose to delete your account or if your account becomes inactive for an extended period, we will initiate deletion of your personal information associated with the account, or anonymize it, after a reasonable time unless we are required to retain it.

Location and Usage Data: We retain precise location data and related alert logs only to the extent needed to proved you with the Services (e.g., to document that an alert was sent, to analyze zone incursions for improving the service, etc.). We do not keep an infinite or excessive history of your movements. By default, detailed GPS location history may be stored on our systems for a limited rolling time frame (e.g., the most recent several weeks, etc.) to support the real-time features and any review of recent incidents. Older location records beyond the retention window may be aggregated or deleted, unless they must be kept longer for investigation of a specific safety incident or legal requirement. Any aggregated data that we keep will not identify you personally.

Communications: If you contact us (e.g., by email, through a support feature, etc.) we may keep those communications and our responses for a period of time to handle your inquiry and improve our support processes.

Legal Compliance: We may retain information as necessary to comply with our legal obligations or to resolve disputes. For instance, if applicable law requires us to keep certain data for a set time (e.g., records of notifications or consents, etc.), we will do so. We may also retain minimal information after account deletion to honor opt-out requests or to maintain records of our actions (e.g., that we deleted your data, etc.) in case of future queries. Once the retention period expires or the purpose of processing has been fulfilled, we will securely destroy or delete your personal data or anonymize it so it can no longer be associated with you. 

In summary, we retain your personal information only for the purpose of providing the service and fulfilling the uses described, treat it as confidential, and do not keep it longer than necessary. If you delete your account or withdraw consent for certain data usage, we will delete or de-identify the relevant information (subject to any legal holds or legitimate interests as noted).

Your Rights and Choices

We believe in transparency and giving users control over their personal information. Depending on your jurisdiction and the applicable laws, you have certain rights regarding your data, as well as choices in how it is collected and used. These include:

Access and Portability: You have the right to request a copy of the personal information we hold about you and to gain access to it in a readily usable format. This allows you to verify the information and even port it to another service. For example, you may request an overview of the data we process about you, including location logs, account details, etc.

Correction: If any of your personal data is inaccurate or incomplete, you have the right to request that we correct or update it. You can also edit certain information directly in the app (e.g., your saved preferences, your contact info, etc.).

Deletion: You may request deletion of your personal information. This is sometimes called the “right to be forgotten.” For example, you can choose to delete your account via the app or by contacting us. Upon such request, we will delete your personal data from our active systems without undue delay, except for information we are required or permitted to retain. 

Objection to Processing: You have the right to object to or restrict certain processing of your data. For instance, you may object to processing that is based on our legitimate interests (e.g., certain analytics, safety assessments, etc.) if you feel it impacts your rights. We will evaluate such objections and stop or modify the processing unless we have a compelling legitimate ground or legal obligation to continue. In practice, this might include opting out of non-essential data collection.

Consent Withdrawal: Where we rely on your consent to process data, you have the right to withdraw that consent at any time. You can do this by adjusting the permissions on your device (e.g., turning off location services or push notifications for the app) or through the app settings. Please note that some core safety features of the app may be limited or unavailable if you revoke consent for certain data. For example, we will not be able to alert you about active exclusion zones if we cannot access your location information. We will respect your choices but want you to be aware of the implications for the Services.

Opt-Out of Communications: While do not send marketing emails or texts, it may be necessary from time to time for us to send you critical safety alerts and service announcements. If at any time you wish to stop receiving non-critical communications , you can opt out by using the unsubscribe mechanism provided or by contacting us. For essential alerts that are part of the Services, the primary way to “opt out” is to discontinue use of the Services or disable your account, since those alerts are intrinsic to the safety functionality. However, you can silence or configure notifications on your device, and we will abide by your device’s notification settings.

Non-Discrimination: If you exercise any of the above rights, we will not discriminate against you for doing so. For example, we will not deny you the use of the LOD Mobile App if you request deletion of your data or opt out of certain processing (except as needed to implement your request).  Similarly, we will not provide you a different level of service other than the natural consequence that some features require certain data to function. California residents are specifically entitled to this non-discrimination right under the California Consumer Privacy Act (CCPA), and we uphold it for all users. To exercise your rights or make any requests regarding your personal data, please contact us. For security, we may need to verify your identity (e.g., by asking you to confirm information we already have, etc.) before fulfilling certain requests. We will respond to valid requests within the timeframe required by law (e.g., within 30 days for many requests).

International Users – Additional Rights (GDPR Notice): If you are located in the European Economic Area (EEA), United Kingdom (UK), or another region with comprehensive data protection laws, you may have additional rights under those laws. These may include the rights mentioned above and sometimes additional ones such as the right to data portability, the right to object to profiling, or the right to lodge a complaint with your supervisory data protection authority. We aim to provide the same level of transparency and control to all our users. If GDPR or similar laws apply to our processing of your data, our legal bases for processing are typically:  (1) Consent for using your precise location and sending you notifications (which you grant when you sign up or allow location sharing and which you may withdraw at any time); (2) Legitimate interests for safety-related processing, fraud prevention, and improving the service; (3) Contract to provide the Services you requested under our Terms of Service; and (4) Legal obligation to comply with laws. European users also have the right to request that we stop processing or delete your data in certain cases, and to complain to a Data Protection Authority if you believe your rights are infringed. We encourage you to contact us first so we can address any concern.

International Data Transfers

Launch On Demand (LOD) is based in the United States (U.S.) and our app and infrastructure are operated in the U.S. If you are using the Services from outside the U.S., be aware that your personal information may be transferred to and stored on servers in the U.S. and/or to other countries where our service providers are located. While the data protection laws of these countries may differ from those in your jurisdiction (and may not offer the same level of protection), we take steps to ensure that your privacy is protected consistent with this Policy wherever your data is processed. If you are in a region like the EEA or UK, we will rely on legal mechanisms for data transfer, such as Standard Contractual Clauses or your consent, and we will implement appropriate safeguards to protect your information. 

By using the LOD Mobile App and providing information to us, you acknowledge the transfer of your data to the U.S. and any other country where we or our vendors operate for processing. We will handle your information in accordance with this Privacy Policy regardless of where it is processed.

Children’s Privacy

Our Services are not directed toward children under the age of 13, nor do we knowingly collect personal information from anyone under 13 years old. The LOD Mobile app and Services are intended for use by adults and individuals at least 13 years of age or older. If you are under 13, please do not use the app or provide any personal data to us. We do not knowingly allow minors under 13 to create accounts. If we learn that we have inadvertently collected personal information from a child under 13 without verifiable parental consent, we will promptly delete such information from our records.

If you are a parent or guardian and believe your child under 13 has provided personal information to us, please contact us immediately so we can take appropriate action. For minors above 13 but under 18, we strongly encourage use of the app under parental guidance and only in compliance with applicable safety regulations.

Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will post the updated Privacy Policy within the app and update the “Last Updated” date at the top of the document. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.

Your continued use of the LOD Mobile app after any modifications to this Policy will constitute your acknowledgment of the changes and agreement to abide by the updated terms. If you do not agree with the changes, you should discontinue use of the app and can request deletion of your data as described above.
